Official Sweepstakes Rules

  1. No purchase necessary. A purchase will not increase your chances of winning.
  2. How to enter: There are three ways to enter. However, each entry, regardless of the manner in which it is submitted, must include the entrant's name, address, daytime telephone number and valid e-mail address, a written essay of two-hundred (200) words or less describing entrant's dream fireplace and how entrant would convert an existing fireplace, or how entrant would add one to a room that has never had a fireplace, and at least one, but no more than (3) 4" x 6" color photo(s) of the entrant's existing fireplace and hearth. Partially completed entries or mechanically reproduced entries will not be accepted. Sponsor assumes no responsibility for lost, misdirected, damaged, stolen, postage-due, illegible or late entries. All entries become the property of the Sponsor and will not be returned. Sweepstakes begins on 12:00:01 a.m. CDT on September 28th, 2009 and ends on 11:59:59 p.m. CDT on November 8, 2009. Mail-in entries must be postmarked on or before November 8, 2009.
  3. Three ways to enter: 1) On-line: Eligible persons may enter one (1) time via the website at www.lumbermens.biz or www.fireplaceandstonecenter.com. All pictures must be entered in the following format JPEG, TIF or GIF. In the event of a dispute as to the identity of the entrant, the authorized account holder of the e-mail address used if entered, if applicable, will be deemed to be the entrant. Sponsor reserves the right to disqualify any entrant that tampers or attempts to tamper with the e-mail entry process or the sweepstakes website. 2) Mail-in: Eligible persons may mail in your entry, limited to one (1) entry per person, mailed separately. Entries must be mailed to Lumbermen’s: 13709 Industrial Road, Omaha, NE 68137 and must be clearly labeled "Lumbermen’s Fireplace Facelift Giveaway". 3) Drop-off: Eligible persons may drop off their entry at the Lumbermen’s locations in Omaha, Lincoln, or Grand Island, NE, or the Fireplace & Stone Center location in Urbandale, IA. Entrants who elect to drop off their entry should do so at the location nearest their home. No more than one submission per entry is permitted.
  4. Sweepstakes open to legal residents of Nebraska and Iowa only, age 18 or older, except employees of Lumbermen’s, its affiliates, subsidiaries, respective advertising, promotion and fulfillment agencies, architects or professional designers and the immediate families of each. Sweepstakes is void where prohibited by law.
  5. Winner(s) will be chosen from all eligible entries on or about November 12th, 2009 by Lumbermen’s or its designated representative, whose decisions are final. Criteria for determining the winner are creativity (60%) and feasibility of project (40%). Except where prohibited, by accepting prize, winner consents to the use of his/her name and photograph or likeness and before and after pictures or descriptions of fireplace or hearth by Lumbermen’s for publicity purposes without further compensation. Winner will be notified by phone and/or mail and winner(s) will be required to sign and return an affidavit of eligibility and liability release within fourteen (14) days of notification, or the prize will be forfeited and awarded to an alternate winner. Prize will only be delivered to addresses within the above mentioned states. Sponsor will make two (2) attempts to contact the potential winner at the address on the entry form. If after two (2) attempts, Sponsor is unable to contact the potential winner, that entry/potential winner will be disqualified and an alternate potential winner's name will be determined on the same criteria as above. There will be One (1) Grand Prize winner determined from entries received at the designated locations- Urbandale, IA, Grand Island, NE, Lincoln, NE and Omaha, NE. A total of four (4) Grand Prizes only will be awarded. Entrants will be required to select which location is closest to their home address.
  6. Four Grand Prize Winner(s) will be awarded- one per location- and will receive a Fireplace Facelift make-over of the fireplace and hearth depicted in the submitted photograph, to be selected and arranged through the nearest participating Lumbermen’s or Fireplace & Stone Center location. The design consultation, renovation work and installation will be scheduled based on availability of labor and materials from the nearest participating Lumbermen’s or Fireplace & Stone Center location. The actual value of the prize will be determined based on the extent of the renovation required, the materials selected, and considerations required by applicable building codes, venting and insulation requirements, condominium association rules or similar requirements. In no event will the total retail prize value (labor and materials, including sales taxes) exceed $5,000 per winner. The Grand Prize make-over must be arranged through Lumbermen’s and must be begun by at least February 1, 2010 and completed by March 31, 2010. Winner is responsible for obtaining all necessary permits and compliance with local building codes, if any. Sponsor will provide lien waivers for all materials and labor provided as part of the prize. Winner is responsible for any costs that exceed the $5,000 limit, regardless of the reason. If the potential winner is unable or unwilling to accept the prize on the conditions stated, the prize will be forfeited. In no event will a potential winner receive or be entitled to receive any compensation in the event of a forfeiture of the prize for any reason.
  7. Odds of winning depend on number of eligible entries received. Prize does not include: Any and all labor or materials not directly provided by Lumbermen’s or Fireplace & Stone Center. Sponsor reserves the rights to substitute a prize of equal or greater value in the event the promotion cannot be completed as contemplated by these Official Rules. Upon forfeiture of this prize for any reason as stated herein, no compensation shall be given. Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppages or any other natural disaster outside its control that may cause the cancellation or postponement of the fireplace make-over. No cash substitutions under any circumstances unless at the sole discretion of the Sponsor.
  8. Prize is non-transferable, not returnable, and cannot be sold or redeemed for cash. No substitutions allowed. No groups, clubs, newsletters or organizations may reproduce or distribute any portion of these Official Rules to its members. All federal, state, local taxes on prize are the responsibility of the winner. By accepting prize, winner(s) agree that Lumbermen’s and their respective officers, director, agents and employees will have no liability or responsibility for any injuries, losses or damages of any kind resulting from the acceptance, possession or use of any prize and they will be held harmless against any claims of liability arising directly or indirectly from the prize awarded.
  9. A list of winner(s) can be obtained by sending a self-addressed stamped envelope to Lumbermen’s: 13709 Industrial Road, Omaha, NE 68137 after November 8, 2009 but before December 10, 2009.
